- Legal Basis and Need for Consent
For technical cookies, the Data Subject’s consent is not required, pursuant to Art. 122 of the Privacy Code, while for certain types of cookies (profiling, marketing, etc.), the legal basis is the Data Subject’s consent, pursuant to Art. 6, paragraph 1, letter a) of the GDPR. Providing data is necessary to achieve the intended purposes, and your refusal may interfere with your access to the Site and/or prevent you from using some of its features. For cookies requiring prior consent, however, providing consent is optional, so failure to provide it does not affect the relationship with the Data Controller.
- Recipients or categories of recipients of personal data
The data may be processed by persons authorized and/or appointed to process data by the Data Controller, pursuant to the EU Regulation and the Privacy Code as amended by Legislative Decree 101/18, Article 2 quaterdecies. The data may also be disclosed to formally appointed suppliers of goods or services external to the Data Controller’s organization, who will process your personal data as data processors, pursuant to Article 28 of EU Regulation 2016/679, i.e., persons providing sufficient guarantees to protect the data subject’s rights (the list of such persons may be requested from the Data Controller by the data subject).
- Processing methods
Personal data will also be processed using IT tools, using organizational and logical methods strictly related to, and proportionate to, the purposes indicated in this policy. In any case, all appropriate security measures necessary to mitigate the risk of violation will be adopted, as required by Article 32 of the GDPR.
- Data transfer to a third country and/or an international organization
The data will not be transferred abroad, either within or outside the European Union. In the event that third parties established in countries outside the European Union are involved, the relevant data transfers are subject to appropriate safeguards corresponding to the adequacy decisions issued by the European Commission and/or the Italian Data Protection Authority, as appropriate. Further information regarding any data transfers to countries outside the European Union, the relevant safeguards adopted, and information regarding the companies appointed as data processors, may be requested from the Data Controller using the contact details provided in this policy.
- Retention Period
The retention periods for data collected via cookies follow the principles of minimization, necessity, and relevance. Specifically, they are retained for the duration of the session and up to a maximum of ___ years, depending on the type. Longer retention periods may be necessary in the event of requests from authorities or the Data Controller’s need to defend its rights in court.
- Data Subject Rights and How to Exercise Them
As a data subject, you may exercise your rights under Chapter III (Articles 15-22) of EU Regulation 2016/679 by contacting the Data Controller by email or regular mail at the addresses indicated in Section 1 of this policy. The rights you enjoy, where applicable, pursuant to EU Regulation 2016/679, are precisely the following:
- to obtain confirmation as to whether or not personal data concerning you exists, even if not yet recorded, and communication of such data in an intelligible form (right of access). Specifically, the data subject has the right to access the following information: a) the purposes of the processing; b) the categories of personal data concerned; c) the persons or categories of persons to whom the personal data may be disclosed; d) the period for which the personal data will be stored or the criteria used to determine that period; e) the existence of the right to request from the controller rectification or erasure of personal data concerning him or her or to object to such processing; f) the right to lodge a complaint with a supervisory authority; g) information on the source of the data, if not collected from the data subject; h) the existence of an automated decision-making process, including profiling, and, in such cases, at least the logic involved; (i) the right to be informed of the safeguards existing when personal data are transferred to a third country; (l) the right to obtain a copy of the personal data undergoing processing;
- Obtain rectification or, where interested therein, integration of data (right to rectification);
- Obtain the erasure of personal data concerning you without undue delay (right to be forgotten);
- Obtain restriction of processing (right to restriction of processing);
- Obtain certification that the aforementioned operations have been notified, including their content, to those to whom the data were communicated or disseminated, unless this requirement proves impossible or disproportionate;
- The right to receive your data in a structured, commonly used and machine-readable format for reuse for other purposes and across different services, and the right to transmit your data from one controller to another without hindrance (right to data portability);
- The right to object at any time, for reasons relating to your particular situation, to the processing of your personal data, including profiling. If the data is processed for direct marketing purposes, the data subject has the right to object at any time to the processing of personal data concerning him or her for such purposes (right to object);
- the right not to be subject to a decision based solely on automated processing (including profiling) that produces legal effects concerning him or her or similarly significantly affects him or her;
- the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal, if the processing is based on Article 6(1)(a) of the EU Regulation or Article 9(2)(a) of the EU Regulation;
- in certain situations, the right to receive communications regarding a personal data breach.
If you believe that the processing of your data violates the Regulation, you have the right to lodge a complaint (pursuant to Article 77 of the GDPR) with a supervisory authority (in the Member State in which you habitually reside, in which you work, or in which the alleged violation occurred). The Italian supervisory authority is the Italian Data Protection Authority, located at Piazza Venezia 11, 00187 – Rome (http://www.garanteprivacy.it/).
- Changes
The features, functions, and services offered, as well as the methods of data processing by the Data Controller, may be subject to future changes. Consequently, this policy may be subject to changes, updates, and/or additions. Users are therefore encouraged to periodically review its content by consulting the Site and/or dedicated web pages.
